EACC Opposes ODPP Bid to Withdraw Ksh32 Million Graft Case Against UoN Official

The Ethics and Anti-Corruption Commission (EACC) has objected to an attempt by the Office of the Director of Public Prosecutions (ODPP) to withdraw a corruption case against Daniel Brian Ouma Okeyo, a senior University of Nairobi official accused of forging academic documents and unlawfully obtaining over Ksh32 million in salaries and benefits.

When the case came up before the Anti-Corruption Court on the morning of Tuesday, 14,October, 2025, prosecutors from the ODPP informed the court of their intention to terminate the proceedings.

However, EACC lawyers opposed the move, saying it was premature, as the accused still enjoys conservatory court orders that had temporarily halted the criminal case.

The Commission told the court that the orders, granted on July 9 this year, remain in force following petitions Okeyo filed in both the High Court and the Labour Court, where both the EACC and ODPP are listed as respondents.

“The said petitions have not been withdrawn and it would only be appropriate for the accused to first withdraw those matters before any steps are taken in this case,” an EACC representative told the court.

EACC further argued that the petitions directly affect the ongoing criminal proceedings, warning that withdrawing the case before their conclusion would undermine due process.

In response, the prosecution said discussions between the involved parties were ongoing to resolve the pending legal matters, assuring the court that any withdrawal would only proceed after the issues were fully settled.

The court directed that a ruling on the application to withdraw the case will be delivered on 30, October,2025.

Okeyo faces multiple charges, including forgery of academic credentials and unlawful acquisition of public property amounting to more than Ksh32 million.

The alleged offenses are said to have taken place between 2015 and 2025, during his tenure in several senior roles at the University of Nairobi, including Deputy Director (Fundraising, Donor Relations and Partnerships), Director of Advancement and Acting Chief Operations Officer.
