Ex-IEBC Staff Jailed Over Ksh. 105M Tender Fraud

The anti-corruption Court in Milimani Nairobi sentenced two former IEBC officials and two directors of Solarmark Technologies Ltd.

The court ruled that the OPP presented a case proving beyond reasonable doubt that the five accused persons on diverse dates between 229 October, 2012 and 23N November, 2012 at IEBC offices, anniversary towers colluded to change the price schedule submitted by Solarmak Technologies in Tender No. IEBC1/2012/2013 for the supply of solar lanterns for the March 2013 General Elections, to facilitate the award of the said tender to Solarmak Technologies Ltd a Company co- owned by Benson Gethi Wangui and Joyce Makena.

The case was heard by Chief Magistrate Hon. L. N. Mugambi while the prosecution was led by Mr. James Warui, Maryanne Mwangi and Pauline Muthuri.

The prosecution called a total of twenty (20) witnesses who gave evidence and produced documentary exhibits to support the charges proffered against the accused persons.

The court found the accused guilty and sentenced them as follows;

“Public procurement remains one of the primary ways through which public funds are embezzled and billionaires created overnight. Public Procurement Officers are crucial in the fight against corruption,* noted the Director of Public Prosecution (DPP) Noordin Haji.

The trial of this case lasted for almost 9 years, the delays being occasioned by existing legal loopholes within the Kenyan criminal justice system exploited by the accused.
