Wajir Women Rep Wants Election Case Dropped

"The legal provisions for depositing security of 500,000 are couched in mandatory terms and should be strictly followed, but the petitioner has failed to comply," court papers state.

Fatuma Abdi Jehow, a Wajir woman representative, now wants a petition filed against her dismissed for lack of service.

Jehow claims that the petitioner failed to provide the required cost security.

“The legal provisions for depositing security of 500,000 are couched in mandatory terms and should be strictly followed, but the petitioner has failed to comply,” court papers state.

She also claims that she learned about the election petition against her from a gazette notice published on September 15th, which appointed judges to hear and decide election petitions filed across the country.

“The instant petition and witness affidavits were filed on the 8th of September hence by law should have been served upon the third respondent on or before the 23rd of September in strict compliance with the rules…,” reads court papers.

She claims that the petitioner has failed to provide the required cost security.

She claims that the petition was never served on time as required by law. She also claims that she learned about the election petition against her from a gazette notice published on September 15th, which appointed judges to hear and decide election petitions filed across the country.

Jehow won the elections (woman representative seat) with 36,064 votes, defeating 11 other candidates who were vying for the seat.
The application will be heard on Friday of next week.
