Former Governor’s Graft Case Pushed To 2023

He is accused of using his company-Oryx service station-to supply petrol and diesel to the county.

Moses Lenolkulal, the former Samburu Governor for two consecutive days failed to appear before Milimani anti-corruption Court for the hearing of his Ksh 84 million graft case.

Mr. Nelson Havi, his advocate appearing before Milimani anti-corruption Magistrate Thomas Nzioka on Thursday, September 15, 2022, presented email medical documents in Court indicating that the governor was indisposed.

He told the Court that Lenolkulal had been diagnosed with serious medical challenges and as result, he couldn’t make it to court.

He further told the Court that Lenolkulala’s attendance in Court physically or in any other form would aggravate his health challenges. He, therefore, applied for an adjournment of the case to a later date.
The state counsel in response said that although they were ready to proceed with the case, the reasons submitted for the application of adjournment were reasonable.
In the ruling, the court said it was in complete agreement that the case could not proceed with the absence of Mr. Lenolkulala due to his health issues hence allowing the adjournment with conditions that Lenolkulal would physically avail himself in Court during the mention date.

The case was slated for further hearing on January 30th and 31st 2023.

Lenolkulal was charged in court with four counts of abuse of office and conflict of interest leading to the loss of Sh84 million in public funds.

He is accused of using his company-Oryx service station-to supply petrol and diesel to the county.

The charge sheet indicates Lenolkulal “knowingly acquired a direct private interest contract between Oryx and Samburu for the supply of fuel”.

He is facing the charges alongside Ndathi and nine others,
It is alleged they committed the offense between March 27, 2013, and March 25, 2019, at Maralal town.
