Former Laikipia North MP Mathew Lempurkel has been slapped with 12 months imprisonment with no fine alternative by a Nairobi court.
The Former lawmaker was charged with assaulting Sarah Korere in 2016.
Sarah Korere is the current Laikipia North MP.
According to the charge sheet, Mr. Lempurkel slapped Sarah on the left cheek and kicked her lower abdomen.
The incident was said to have occurred in the board room of the former CS for internal security Joseph Nkaiseri.
The former Legislator was before Milimani Senior Principal Magistrate Hellen Onkwani.
In her sentencing, the duty magistrate noted that the accused was as guilty as charged.
"The prosecution has discharged its duty in proving its case beyond a reasonable doubt. The accused is found guilty as charged for the offense of assault causing grievous harm. The accused person's defense is a mare denial. He is therefore convicted as per provisions of section 215 of the criminal procedure code cap 75," noted the magistrate.
The defense in mitigation, pleaded with the court to consider a non-custodial sentence.
"My client has been in court for five years and has cooperated with the court. I, therefore, urge the court to consider a non-custodial sentence," said defense lawyer Kanchori.
" Having considered value and the nature of the offense and the rising cases of violence in the country, I have also considered the fact that the accused is a first-time offender I note from the record and mitigation that the accused is a leader who should be an example to others I hereby proceed to sentence the accused to one-year imprisonment," ruled the magistrate.
