The Director of Public Prosecution is seeking to withdraw a corruption case against Deputy President Rigathi Gachagua.

The public prosecutor in Court said the prosecution was unable to make full disclosure of the material evidence they would be relying upon to the defence because the DCI declined to avail the evidence to the prosecution office.

According to the ODPP, the DCI failed to respond to the letters from the prosecution requesting him to produce the evidence required to successfully prosecute DP Gachagua.

“The investigating officer admits that some crucial areas of investigation in this matter were not adequately covered as he was not given sufficient time to investigate the matter and make proper recommendations.”

The DP is charged alongside nine others — Nyeri senator William Wahome Mwangi, Anne Nduta Ruo, Julianne Jahenda Makaa, Samuel Murimi, Grace Wambui Kariuki, Lawrence Kimaru, Irene Wambui Ndigiriri, David Reuben and a company M/s Rapid Medical Supplies.

They are accused of fraudulently receiving Sh7,330,011,265 through three bank accounts at Rafiki Micro-Finance bank while knowing that the monies were proceeds of crime.

The fraud was committed on diverse dates between 2013 and 2020 in Nairobi.
