The ousted Deputy President Rigathi Gachagua has moved to the Court of Appeal challenging a decision by the High Court that found DCJ Philomena Mwilu acted lawfully in constituting a three-judge bench to hear petition challenging his impeachment.
His excellency Gachagua in his appeal is asking the Court of Appeal to suspend the proceedings before the High Court which has been slated to commence tomorrow October 29, 2024.
The three-judge bench consisting of Justices Eric Ogola, Anthony Mrima and Fredah Mugambi is set to hear an application by the Attorney General and National Assembly seeking to set aside orders blocking Prof Kithure Kindiki from taking oath of office as the new DP.
According to Gachagua through Advocate John Njomo, the three-judge bench ruling finding that Mwilu can assign a bench is erroneous.
