EACC has recovered a Government house worth Kes.52M grabbed from the Kenya Civil Aviation Authority in Nyali estate by Luka Kimutai and his spouse Sally Jepkpoech Cheptoo.
According to the Ethics and Anti-Corruption Commission, the fraudulent acquisition was aided by ex-Commissioner of Lands Sammy Mwaita.
While delivering her judgment, Lady Justice Nelly Matheka of the Mombasa Environment and Land Court concluded that before the land parcel was grabbed, it had been set aside for KCAA staff.
The land parcel has a 4-bedroomed bungalow and servant quarter erected on it.
Justice Matheka issued a declaration that the allocation of the property to Luka Kimutai was irregular, fraudulent, and illegal, and thus null and void.
Accordingly, she ordered cancellation of the title and all entries made in the land register in favor of Luka Kimutai.
The Nyali recovery case is part of recovery suits worth over Kes.40 Billion currently pending before various courts across the country where EACC is seeking orders to compel the illegal owners of public property to surrender the same back to the public.
