The Directorate of Criminal investigation through the office of the DPP filed a motion in Milimani Law Courts seeking to prolong the detention of Joseph Ochieng Barasa.

He is accused of stealing a firearm and obtaining money by false pretense. He is said to have stolen a pistol serial B606494 on 6th November 2020.

At the time of the crime, the accused person was riding a motorcycle reg NO. KMDE 243U. According to the application, this was the motorcycle used to transport the stolen firearm. Mr. Barasa was arrested yesterday 6th January 2022 and the DCI requested more days to investigate the matter.

The prosecution sought to move the Court to grant a ten days detention order for the accused person to enable the applicant to conclude investigations before charging him in Court.

The application was supported by an affidavit sworn by NO. 78919 CPL Stephen Kosgei attached to DCI- Transnational Organized Crime Unit.

The respondent is believed to belong to a cartel of selling firearms with fake firearm certificates and taking civilian firearms ID cards.

The said firearm is yet to be recovered and the officers are on the ground following the leads to recover the same. Further, the application says that the accused person is a flight risk hence the Court should consider denying him bond and or bail.

The Court ruled that the ten days proposed days in the application are exceedingly many and proceeded to grant five days detention at Muthaiga Police Station.

The case will be mentioned on 13th January 2022.
