The High Court has declared that the Speaker of the National Assembly, Hon Moses Wetangula erred in law by declaring Kenya Kwanza Alliance as the Majority party in Parliament.
According to the three judge bench comprising of Justices Chigiti, Mugambi and Justice Ngaa, although the speaker of the the National Assembly had at his disposal an evidence from the registrar of political parties indicating that Azimio Coalition was the majority party, he acted in complete disregard of the said evidence.
The Judges said that allegations by the speaker and the majority leader Hon.Kimani Ichung’wa that there existed a post election agreement between One Kenya Alliance and other Azimio Coalition parties was never supported by any evidence.
“Based on the information provided by the registrar of political parties, these parties were members of Azimio La Umoja coalition. There was no evidence that this court or any tribunal had suspended the Azimio La Umoja coalition agreement.” Said the Judges.
The judges emphasized that the voters had already determined the majority party through the election process and that the Speaker’s decision could not override the will of the electorate.
Court Quashes Speaker’s Ruling
As a result, the High Court has issued an order nullifying Speaker Wetangula’s declaration that Kenya Kwanza Alliance is the majority party in the National Assembly.
This ruling marks a significant legal victory for Azimio La Umoja and raises questions about the Speaker’s impartiality in handling parliamentary affairs.
The decision may also have broader political implications as the ruling coalition navigates parliamentary leadership dynamics.
