The High Court has dismissed a petition filed by the Law Society of Kenya (LSK) seeking to compel the Inspector General of Police and state security agencies to produce eight individuals allegedly abducted by police officers.
Justice Bahati Mwamuye ruled that the petitioners failed to provide sufficient evidence demonstrating that the missing individuals were in the custody of the respondents.
The court noted that the claims were not adequately substantiated.
“The applicants did not prove that the seven individuals were in the custody of the respondents, nor did they convince the court that the seven, along with an eighth individual, are being unlawfully detained by any known or unknown parties,” the judge stated.
The court further observed that six out of the eight individuals had since resurfaced from locations unrelated to police custody.
As for the remaining two, there was no evidence indicating they were being held by police or in any identifiable location that would warrant the issuance of a writ of habeas corpus.
Consequently, the court found no merit in the application and dismissed it.
