The High Court has dismissed a petition arising from the 1998 bombing of the United States Embassy in Nairobi, ruling that the case lacked merit.
In its decision, the court held that although there was a delay in filing the petition, the explanation given by the petitioners was satisfactory and did not, on its own, bar the case.

However, on the substantive issues, the court found that the petitioners failed to prove that the Government of Kenya had prior, actionable intelligence about the attack or that it neglected to act on any such intelligence to prevent the bombing.
The court further ruled that the petitioners did not demonstrate that the government violated the human rights of victims in the aftermath of the attack.

As a result, Justice Lawrence Mugambi dismissed the petition in its entirety and directed that all parties to bare their own costs.
