The High Court in Nairobi has directed that the current status remains in place in a petition filed by Kinatwa Sacco Society, KAM Sacco and 11 others against the Energy and Petroleum Regulatory Authority (EPRA), the Nairobi County Government and seven other respondents.
The matter came up for mention before Justice E. C. Mwita to review the progress of negotiations among the involved parties.
During the session, the court received a report on the meetings held between the petitioners, regulatory authorities and other stakeholders.
From those engagements, parties agreed on two key resolutions aimed at maintaining order and preventing operational disruptions.
First, the petitioners would continue operating from their current locations without interference.
Second, all parties would ensure that entry and exit points within the affected petrol stations remain unobstructed for safety and accessibility.
After considering the updates, Justice Mwita granted the parties additional time to continue with negotiations in hopes of achieving an amicable settlement.
The court further affirmed that the existing operating conditions at the petrol stations would remain unchanged.
This means that the petitioners are allowed to continue their operations at the disputed sites, with the prevailing arrangement protected until the court issues further instructions.
The judge emphasized the need to maintain order and directed that the interim measures already in place must subsist for the duration of the ongoing operations.
Any party attempting to disrupt the current status would be acting contrary to the court’s directions.
The matter is scheduled for further mention before Justice L. Mugambi on 26th January 2026, when the court will issue additional directions based on the outcome of ongoing discussions.
The petition, which touches on regulatory compliance, transport sector operations and access to key service stations, remains one of the closely watched public-interest matters involving multiple stakeholders in the Nairobi transport ecosystem.
