Justice Bahati Mwamuye has lifted conservatory orders that had barred the arrest or detention of governors and other affected individuals in a case before the High Court in Kiambu.
In his ruling, the judge vacated the interim orders after finding that the petitioners’ proposed amendments had fundamentally altered the legal basis of the case.
The court held that the amendments introduced new issues that were not part of the original pleadings, rendering it untenable to sustain the earlier protections.
The conservatory orders had initially shielded governors and certain public officials from arrest or detention pending the hearing and determination of the petition.
With the orders now set aside, law enforcement agencies are no longer restricted by the earlier court directives.
The matter will now proceed on the basis of the amended petition once it is duly filed and served.
