Keen analysts will remember the altercation between Sunny Professor Makau Mutua and maverick former Machakos Senator Johnstone Muthama. – By Henry Kimoli
The trigger was Mutua’s bombshel shell that he had been approached to support DP Ruto Presidency against the dynasty.
To the politically uneducated, this was a one off event. But it now vindicates intelligence reports that DP Ruto had reached out and convinced the civil society movement to support him against the BBI duo of Raila and his boss, Uhuru Kenyatta.
Ruto’s handlers used the hardline that the duo were out to kill democracy…and introduce benevolence dictatorship.
Fast forward to 2021. Maverick political economic David Ndii announces support for Ruto, and things eventually fall in place.
Ndii is one of the petitioners in the BBI bombshel case. Did he engineer a legal coup.
Analysts fear that the judgement delivered after a painstaking 5 hours may have been drawn elsewhere, and conferred to the judges to present to the public.
This may be far fetched. But not an impossibility in a country whose corruption index is up among global leagues.
Since 2018, talk has been rife that the Civil Society has been a player in the DP Ruto’s camp.
Mutua, in a, stinging rebuke to such a scenario said the increasingly powerful civil society could never work with Ruto. He may soon swallow his words.
The nomination of Martha Koome as the next chief justice speaks volumes of who is in charge of the second hand of the Judiciary.
Effectively, Professor Makau Mutua, the undisputed patron of the civil society movement in Kenya played a key role in the management of the seven consolidated cases…and the canny formation of a five Judge bench to determine the future of Kenya.
The Judgement, signed off by High Court Judges sets the stage for major political realignment in Kenya…and a massive political fallout.
Other leading Civil Society rights Advocates are John Githingo, DP William Ruto critic turned buddy David Ndii, Boniface Mwangi among others.
A furious reaction will be expected from the dynasties who feel slighted by this judgement.
