The Independent Electoral and Boundaries Commission will decide whether Mombasa county gubernatorial aspirant Mike Sonko Mbuvi will be on the ballot or not.
Speaking to the media on Saturday, IEBC chairman Wafula Chebukati stated that he has yet to review the Supreme Court’s decision upholding Sonko’s impeachment.
“I have not had time to look at the judgement by the Supreme Court. As a team we shall discuss and look at the issues and make a decision next week,” he said.
Sonko was cleared to run for Mombasa Governor’s seat in the August elections by the commission last week on Wednesday.
It came after a three-judge bench overturned the court’s previous ruling and directed the commission to approve the flamboyant politician for the Mombasa governorship.
On Friday, however, the Supreme Court upheld the decisions of the High Court and Court of Appeal, confirming Sonko’s impeachment.
The Supreme Court agreed with the lower courts’ decisions that Sonko was properly removed from office.
The seven-judge panel, led by Chief Justice Martha Koome, cited seven reasons for their decision, including the fact that Chapter Six of the Constitution on Leadership and Integrity was not enacted merely for show.
“There were four counts of impeachable charges against the appellant. The County Assembly, the Senate and the two superior courts were convinced that the charges were proved to the standard required in such circumstances. No error for their analysis and conclusion has been presented,” court ruled.
Sonko, on the other hand, has remained upbeat, stating that he is and will be on the ballot for the Mombasa gubernatorial race, arguing that the electorate has the right to choose the leaders they want.
He chastised the CJ for sitting on the bench that delivered the decision on Friday despite having stated her position on the case.
Sonko’s political future is now up to the IEBC.
