Impeached Waititu takes battle to Senate

Kiambu Governor Ferdinand Waititu has written to the Senate to have his impeachment withdrawn.

The troubled governor, through his lawyer, termed the impeachment unconstitutional, as the county assembly lacked quorum.

“For the reason that the (total) number of the MCAs is 92, thus the statutory quorum required under Section 33 (2) of the County Governments Act to pass such a special motion is 62 members. However, the members’ attendance was 57,” read the letter.

Waititu went on to claim that 35 of the MCAs were at the Lake Bogoria for a retreat and had even swore affidavits that they would be absent to debate the motion.

“The speaker unilaterally adjourned the assembly during the voting, yet a motion of this kind ought not to have been adjourned at the voting stage,” added the letter.

Waititu further informed the Senate that his legal team would seek to take up the matter to the DCI for investigations, citing the unlawful nature in which he was ousted.

“These actions by the speaker are actionable in a court of law and our client has requested us to seek legal redress against the conduct of the speaker, which includes but not limited to raising a complaint with the DCI,” further read the letter.

Governor Waititu is currently facing a corruption case against him, concerning the awarding of tenders to close family members. The impeachment motion against him was brought to the house by Ndenderu MCA Solomon Kinuthia.
