A voter has petitioned the court to prevent Kirinyaga senator-elect James Murango from taking office on the grounds that he violated Chapter Six of the Constitution.
According to Antony Murimi, the senator-elect on a UDA ticket has a pending forgery case at the Mombasa Law Court and is thus unfit for office.
Murango is accused of forging a Sh8.8 million Kenya Ports Authority tender, which Murimi claims violate the laws of integrity.
“Pending inter-parties hearing, the court be pleased to issue an interim mandatory injunction suspending gazettement of the senator-elect by the IEBC,” reads the petition.
According to court documents, as a director of ports and harbors support services, he allegedly obtained money from the KPA to supply Grove crane spare parts.
Murimu also claims that the senator-elect was charged with two counts of forgery, two counts of uttering a false document, and two counts of procurement fraud.
It is his contention that Justice Mumbi Ngugi made the decision that all leaders in constitutional office who have been charged with corruption should resign.
“The petition reveals overwhelming grounds for disqualifying the Kirinyanga Senator-elect from taking office on the grounds of failure to satisfy moral and ethical requirements prescribed by the Kenyan constitution, the public office Ethics Act Cap 183,” he claims.
