Johnson Sakaja Poised To Win Nairobi, Amid Missing Results

Johnson Sakaja has won the Nairobi County Gubernatorial race with 699,392 votes.

This is after IEBC concluded tallying of results from all the 17 Constituencies in Nairobi County.

Polycarp Igathe, the Azimio Coalition candidate managed position two in the race with 573,516 votes.

The ODM chair, Edwin Sifuna won the County Senatorial post with 716,651 votes, while Esther Passaris won the Nairobi County Woman Representative with 698,929 votes.

Mr Albert Gogo, the Nairobi County Returning Officer said that he has received the results from all the 17 Constituencies in Nairobi County.

However, results from 19 polling stations were not submitted to the County tallying centre.

For the Governor election results from 6 polling stations were not submitted, for Senator 6 polling stations and for Woman Rep 7 polling stations.

That notwithstanding, the Law gives the County Returning officer a leeway to proceed and declare the winners in the respective three County election positions in a situation whereby after computing the number of registered voters in the affected polling stations, he/she is certain than even the voters were to vote 100% in favor of the candidate with the second highest number of votes cannot change the outcome of the election, the the County RO will be able to declare winners of the respective positions as provided for under the Law.

Section 87 (1) of the Elections General regulations provides that the Constituency Returning Officer shall as soon as practicable deliver to the County Returning officer all forms 37B,38B and 39B from the respective Constituencies and collated results.

It further provides that the County Returning officer shall upon receipt of the results from the Constituency Returning Officers as contemplated under the said Section, tally and announce the results for the County Governor, Senator and Woman representative to the national assembly.

Further, the County Returning officer is required by the Law to compute Forms 37C, 38C and 39C set out in the schedule in which the County Returning officer shall declare as the case may be; name of the respective Election area, total number of registered voters, voters cast in favor of each candidate in each polling station, number of rejected votes for each Constituency, aggregate number of votes cast in the respective election area and aggregate number of rejected votes and sign and date the relevant forms publicly and declare the results for the position of County Governor, Senator and Woman Representative and issue certificate to the persons elected in the respective positions.
