The Judicial Service Commission (JSC) has issued a scathing rebuttal to the Daily Nation over its November 25 headline, “Why 10 Judges face ouster over Ksh. 3bn land feud.”
The Commission accused the publication of sensationalism and presenting a biased narrative that unfairly tarnishes the reputation of the implicated judges.
The controversy stems from five petitions filed on October 11, 2024, by Mr. Kung’u Muigai.
These petitions seek the removal of ten judges over their involvement in a protracted legal dispute dating back 32 years to High Court Civil Case 1219 of 1992.
The case has since been adjudicated at the High Court, Court of Appeal, and Supreme Court by various judges, some of whom are retired.
While confirming the receipt of the petitions, the JSC emphasized that it is processing them in strict compliance with the Constitution and the Judicial Service Act.
However, the Commission expressed alarm over the Daily Nation’s speculative reporting, which it claims has exposed the judges to undue reputational harm.
“The article speculates on potential outcomes and unfairly entrenches unsubstantiated narratives, despite the matter being yet to be heard or determined,” the JSC noted in a statement.
The Commission called on the media to uphold fairness, balance, and professionalism, urging them to allow the due process to unfold without stoking public sentiment or creating unwarranted speculation.
This development highlights the delicate balance between press freedom and the responsibility to report accurately on sensitive judicial matters.
