Man Files Petition To Sack Four IEBC Commissioners

According to a petition signed by two lawyers, John Wangai and Kevin Kiarie, the four commissioners should be removed from their positions for violating the Constitution

A petition has been filed in the National Assembly to begin the process of removing four Independent Electoral and Boundaries Commission (IEBC) commissioners on grounds of gross misconduct and incompetence.

Juliana Cherera, Francis Mathenge Wanderi, Justus Ngang’aya, and Irene Cherono are the commissioners who rejected William Ruto’s presidential election results on Monday, August 15.

According to a petition signed by two lawyers, John Wangai and Kevin Kiarie, the four commissioners should be removed from their positions for violating the Constitution, Election laws, and other enabling provisions of the laws.

“The honorable house should begin removal from office proceedings against the four IEBC commissioners in accordance with Article 251 and 88 on grounds of serious violations of the Constitution of Kenya 2010, the Election Act 2011, the IEBC Act 2011, the elections laws (amendment) Act 2016, and the Election Offenses Act 2016 in accordance with Article 119, which states that everyone has the right to petition Parliament to consider any matter within its authority.” Reads the petition. 

According to the lawyers, the said commissioners were announcing constituency results throughout the process, so their claims of not being involved in the entire process are false, and their actions were unpatriotic and violated, infringed on, and threatened the oath of office they swore to protect and defend the constitution and all other enabling provisions of the law.

The petitioners also claim that the four commissioners who disavowed the final presidential results pose no threat to the legality of the results announced by IEBC Chairman Wafula Chebukati.
