JSC Approves Justice Chitembwe Removal

The Judicial Service Commission (JSC) has recommended the removal of Justice Said Chitembwe from his position due to integrity concerns and allegations of gross misconduct.

the Commission stated in a report filed on May 4 that they had reviewed the petitions filed against Justice Chitembwe and determined he was unfit for office.

“At its meeting on 27 April 2022, the JSC considered the report of the panel on the petition initiated by the Commission on its own motion and is satisfied that the Petition discloses grounds for the removal of Hon. Mr. Justice Chitembwe Said Juma from office, pursuant to the provisions of Article 168 (1) of the Constitution,” the JSC stated.

Through Chief Justice Martha Koome, the commission has written to President Uhuru Kenyatta for further action.

“Accordingly, the Commission resolved to send the Petition to His Excellency the President for his further action in accordance with article 168(4) of the constitution,” the commission added.

According to the constitution, if the president receives a petition from the JSC for the removal of a judge, he must suspend the judge and convene a tribunal to investigate the allegations leveled against him within 14 days.

Chitembwe’s troubles began when former Nairobi Governor Mike Sonko shared videos and photos of the judicial officer allegedly accepting bribes on cases before him.

However, the judge denied the claims, and the petitions filed before the JSC was later withdrawn for unknown reasons.

The JSC, on the other hand, chose to proceed with the petition on its own initiative.
