Kajiado: Katoo Petitions Ole Lenku Win

Immediate former Kajiado South MP Katoo Metito has sought to overturn the declaration of Joseph Lenku as governor in an election petition filed on Thursday.

Nchogu, Omwayanza & Nyasami Advocates Company acting on behalf of Metito and his running mate in the August election, Pere Judy Naiyeyo, filed the case (HCCHREP/E001/2022) through e-filing to the High Court Constitution and Human Rights Election Petition.

Lenku’s deputy, Martin Moshisho and three others have been cited in the case.

The petitioners are aggrieved with the results declared by the second respondent (IEBC) for the subject gubernatorial election.

Their grievance is that the elections were not conducted under the constitution and electoral law.

The petitioners want the interlocutory stage, an order of scrutiny, recount and audit of election materials at the various polling stations and tallying centres to be carried out.

They also pray for the court to invalidate the return of the third (Lenku) and fourth (Moshisho) respondents as Kajiado governor and deputy governor.

Metito wants the court to declare him the duly elected governor as the various stages of result declaration were not verifiable, accurate, transparent and accountable.

Alternatively, Metito wants the petition court to invalidate/annul the Kajiado gubernatorial election held on August 9.

“Consequent to the grant of any/all of the alternative reliefs, an order be and is hereby issued directing the 1st respondent (IEBC) to organise and conduct a fresh gubernatorial election in strict conformity with the constitution, the Elections Act, 2011 and the Regulations,” the lawyers said.

Lenku garnered 117,600 votes.

Metito (UDA) came a close second with 111,725 votes, with former governor David Nkedianye (Jubilee) garnering 75,337 votes. 

Ambrose Kago (Independent) got 2,661 votes
