Kenya Ordered to Prosecute Officers Behind Pakistani Journalist Arshad’s Death, Awards Family Sh10 Million 

Big win to the family of slain Pakistani Journalist as the Kajiado High Court rules that his killing by Kenyan police officers in 2022 was unconstitutional.

Kajiado High Court Judge, Justice Stella Ngali Mutuku ruled that Kenya violated the deceased, Arshad Sharif fundamental rights to life, dignity, and freedom from torture, cruel, and degrading treatment.

“In view of the analysis above, I find that the respondents, jointly and severally through their actions violated the rights of the petitioners,” ruled Lady Justice Mutuku.

The deceased Shariff is believed to have been executed by police officers on October 23, 2022 at Kajiado County.

The court has awarded Sharif’s family, Ksh10 million in compensation, with interest accruing until full payment is made.

The court also criticized the Office of the Director of Public Prosecutions (ODPP) and the Independent Policing Oversight Authority (IPOA) for their failure to prosecute the two police officers allegedly involved in Sharif’s murder.

The court ruled that both the ODPP and IPOA had violated Shariff’s rights by not holding the responsible officers accountable.

The court has ordered the ODPP and IPOA to conclude their investigations promptly and to charge the two officers involved in the execution.
