George Kinoti, the director of the Directorate of Criminal Investigations (DCI), has submitted an affidavit to challenge the second warrant of arrest issued against him by the High Court on Tuesday, December 15, claiming that he has been harassed.
In an affidavit filed on the evening of December 14, the country’s sleuth requested that the court grant a stay order on the warrant of arrest and the continuous harassment he was receiving from businessman Jimi Wanjigi and his wife, Nzisa Wanjigi.
Kinoti expressed concern that unless the court interfered in his case, the harassment would continue.
The affidavit was filed in support of Attorney General Paul Kihara Kariuki’s application to stop Kinoti’s arrest, which he filed through his lawyer, Cecil Miller, on Tuesday, November 30.
The appeal was dismissed by High Court Judge Anthony Mrima, who stated that there was no new or compelling evidence to allow the application.
“The term “review” refers to a court’s departure from an earlier decision. The applicant relied on the issue of fresh material being discovered that was not available to the trial court and would have led to a different conclusion “The Judge noted.
Justice Mrima ordered that Kinoti be arrested by Inspector General of Police Hillary Mutyambai for failing to surrender to prison for contempt of court.
