Noordin Haji, the Director of Public Prosecutions, has been given more time to review the Ksh 2.2 billion tax evasion charges filed against businesswoman Mary Wambui.
On Tuesday, October 18, 2022, Milimani Anti-Corruption magistrate Felix Kombo granted the DPP’s request to review the charges of tax evasion before deciding whether or not to drop them.
The DPP, through Judy Thongori, informed the court that he has yet to finalize his decision in the case against Wambui and her daughter Purity Njoki.
As a result, the magistrate granted the DPP until December 5 to make his final decision on the case.
According to the court, the review of the charges against Wambui and her daughter is based on a request made by the accused in a letter dated September 14 to his office.
“Based on the accused’s request, our office wrote to Kenya Revenue Authority (KRA) on September 29 to seek their views on the matter. On October 6, we received a response from KRA in which they indicated they were in engagements with the accused persons who were taxpayers in regards to review of the tax payable after the accused raised objection to the amount due.” Said the prosecution.
“As a result, it appears that an out-of-court settlement is being considered in this regard, and we have not had time to seek directions from the DPP Haji on how to proceed with the matter in light of this new development,” proceeded the prosecution.
However, Wambui and her daughter, represented by lawyers Nelson Havi and Adrian Kamotho, did not object to the DPP’s request for an extension of time until December 5.
Wambui and her daughter are charged alonside Purma Holdings, with knowingly and unlawfully omitting taxes due in income tax returns amounting to Ksh 2.2 Billion filed with the Commissioner of Domestic Taxes from 2014 to 2016.
