Four alleged land fraudsters were presented to the court after they were caught trespassing into land believed to be owned by a prominent Kenyan leader
The DCI presented an application to have the four; Muhamed Muhammud Wako, James Owino Opere, Jonah Saluni Tuuko, and Samakin Lesingirani detained for forcefully entering land LR NO. 1159/88.
They are said to have started searching for beacons and were suspected to have been planning to sell off the land located at Karen.
The application requested that the Court detains the four for 7 days.
It proceeds to say that the matters are complex and require further investigation to unveil the motive behind the forcible entry to the land.
The state notes that the land is a property of a prominent leader in the Country.
However, the investigation officers says due to security issues, he will not disclose the owner.
The defense led by Lawyer Danstan Omari objected to the application. They submitted that it is unreasonable for the state to claim that they do not know the owner of the said land yet they have the plot number.
Mr. Omari told the Court that he has information from his client that the land belongs to the President of the republic of Kenya.
He further pleaded with the Court to revoke the application noting that the accused persons are just common citizens who cannot be of any threat to the investigation process.
The Court Ruling.
The Court ruled that the request to restrict the suspects for 7 days is excessive. It therefore granted 2 days custodial period with an alternative bail.
The case will be mentioned on 12th January 2022.
