Milimani Anti-Corruption Court summoned a law firm representing a company at the centre of a corruption case against former National Assembly Majority Leader Amos Kimunya and two others.
On Monday, October 31, 2022, Milimani Anti-Corruption Magistrate Peter Ooko issued the summons against Atundo and Macharia Advocates acting for Midlands Limited after it was revealed that the former directors, including Kimunya’s co-accused Junghae Wainaina, had ceased to be directors.
Wainaina’s lawyer informed the court that his client had ceased being a director in the company and would not defend the firm in the Ksh 60 million fraud case.
Kimunya, Wainaina, and Lilian Wangiri had appeared in court to inform the new trial magistrate of their plans to defend themselves in the graft case.
“I hereby serve summons on Atundo and Macharia Advocates, who are representing Miland Limited, to explain who will represent the company in the proceedings. The case has been rescheduled for November 18, when the accused will provide defence instructions in accordance with Section 200 of the Criminal Procedure Code (CPC) “Magistrate Ooko ruled.
Kimunya, through his lawyer Brian Onyango, informed the Court of Appeal that he has since filed an appeal challenging the High Court’s decision to reverse the lower court’s decision to acquit them.
The former Kipipiri MP was found to have a case to answer by High Court Judge Esther Maina on charges of allocating public land to Midlands Limited, a company he owns.
The said allocation took place on June 30,2005. At the time Kimunya was serving as the minister of lands.
