Hearing of a case where Nandi Senator Samson Cherargei is charged with Ethnic contempt and incitement to violence of the year 2019 commenced today in Milimani Law Courts.
However, all of the three Advocates representing Senator Cherargei failed to turn up in Court without notice.
It was unclear why the learned counsels neglected their client in a matter that can extinguish his political career upon conviction.
Chief Magistrate Micheni Wendy had a tough time in Court when the Senator showed up without an advocate and asked the Court to grant him another hearing date to put his house in order.
Nevertheless, in her ruling, the magistrate held that the case hearing date was agreed upon by all parties and noting that the case has been pending for over two years, it would be an attempt to defeat justice by adjourning the case.
The Court took testimony from the first prosecution witness, Wycliffe Mwatu , an investigator working with National Cohesion and integration commission.. Mr. Mwatu noted that by use of a software, the utterances by the Senator were plucked from the system.
He proceeded to say that during the forensic analysis, he noticed that an attempt had been made to infuse data so as to alter the original data and that the original data send by the Senator has already been pulled down.
In cross examination, the Senator turned down his legal opportunity of cross examining the witness, instead he asked for the proceedings vowing to challenge the Lower Court in the High Court for commencing the case in absentia of his Lawyers.
The case proceeds tomorrow March 29, 2022.
