Milimani Law Courts Anti-corruption magistrate Thomas Nzioki adjourned the case to Thursday, September 15 after the defence lawyers told the court the accused governor was unwell.
Governor Lenolkulal is said to be the owner of the station embroiled in the Ksh 84 million oil scandal.
The station was used to supply petrol and diesel to the county, leading to the loss of Sh84 million.
EACC officer Joel Khisa Nyongesa on Monday told anti-corruption magistrate Thomas Nzioki that they conducted searches in Lenolkula’s home and that of Hesbon Ndathi, an accused person in the case and obtained a tenant agreement between the two.
The agreement revealed that Lenolkulal is the proprietor of Oryx service station in Maralal and Ndathi was the tenant.
Part of the agreement was that Oryx is fully owned by Lenolkulal but he had availed the station to be fully run by Ndathi.
“Ndathi undertook to manage the day-to-day running of the station including management of the station and was to provide Sh7 for every litre sold,” Nyongesa said.
Lenolkulal has been charged in court with four counts of abuse of office and conflict of interest leading to the loss of Sh84 million in public funds.
He is accused of using his company-Oryx service station-to supply petrol and diesel to the county.
The charge sheet indicates Lenolkulal “knowingly acquired a direct private interest in contracts between Oryx and Samburu for the supply of fuel”.
He is facing the charges alongside Ndathi and nine others,
It is alleged they committed the offence between March 27, 2013 and March 25, 2019 at Maralal town.
