The prosecution in a case where Meru Senator Mithika Linturi was accused of hate speech over his madoadoa remarks has requested the court to withdraw the case due to lack of evidence.
Following the delay, Chief Magistrate Edna Nyaloti of the Nakuru law courts declared on Monday that the case had been closed.
Early this year, Noordin Haji, the Director of Public Prosecutions, requested an investigation into Linturi’s madoadoaremarks.
Haji instructed the Inspector General of Police, Hillary Mutyambai, to launch inquiries into the senator’s remarks in a letter to him.
According to the DPP, Linturi’s utterances could incite contempt, hatred, hostility, violence or discrimination.
