President of the Law Society of Kenya Erick Theuri has vowed to sue President Uhuru Kenyatta over his decision to alienate the Kenyatta University land three weeks before his departure.
According to Theuri, the university is holding the land in trust for the general public, particularly young people who will benefit as the university grows exponentially.
With accommodation being one of the most difficult challenges that most universities face, Theuri believes that the vast tracts of land are intended to help accommodate extra population in the event of an overspill.
“The university holds the land for the future generations, so an attempt to alienate the land in in the last day of administration is not proper for the development of the university and the learners,” Theuri said.
According to the LSK President, the petition will also seek a declaration that the president’s procedure is both eligible and contrary to clear legal procedure regarding land allocation.
“We have seen the president issuing threats to the Vice Chancellor of the university, just like the threat issued to the judiciary upon nullification of election and these threats might be actualized,” Theuri said.
Theuri also stated that they are working around the clock to prepare a formal petition to stop the presidential directive of subdividing the varsity land to World Health Organization (WHO), Kenyatta University Teaching and Referral Hospital (KUTRH), and resettlement of Kamae scheme squatters.
“We are in hurry to file the petition as early as tomorrow to suspend the alienation directives. We are ready for legal battle like no other, the president’s direction must not be punitive to innocent students who stand to be beneficiaries,” Theuri stated.
President Uhuru’s tough moves saw KU Vice Chancellor Prof. Wainaina abruptly leave the university on Monday, just days after Uhuru promised to deal with his “critics” swiftly and effectively before handing over power in three weeks.
