A young man alleged to have defiled 20 children at Marurui area in Roysambu will now have to remain in custody until Thursday October 17, awaiting the doctor report on whether he is mentally fit to stand trial.
The defence lawyer Sam Nyaribo pleaded with the Court to issue an order requiring the doctor who assessed the intended suspect, Kilunda Lenguyana Mandiji alias Kilunti Mtalii to appear in Court to explain the confusion arising in the medical report dated October 9, 2024,
According to the lawyer, the said medical report indicated that the suspect is fit to face charges but there is one month medication prescribed by the doctor and the accused was supposed to start taking drugs for a period of one month.
He stated that the suspect immediately started medication while in custody but after two days the medicines were taken away by police.
The lawyer told the magistrate that he cannot tell the kind of medication prescribed and what was treated hence sought the doctor to be summoned to describe to the relationship between the medication and the accused being fit for trial.
In his ruling, Chief magistrate Bernard Ochoi noted the content in the medical report citing that there was medication intended to take one month but no description followed to indicate the treatment,
He also noted that the medicines prescribed from mental facility and the same cannot be ignored until a professional doctor confirms the type of treatment and what the treatment was for.
He ordered the suspect be detained at Industrial Area Police Station until October 17, 2024.
