Six key witnesses have been summoned by police for questioning and statement recording in connection with the death of Safari Rally driver Asad Khan.
In an exclusive interview with a local newspaper, lawyer Steven Kimathi, who represents rally driver Maxine Wahome, the late Asad’s girlfriend, revealed that police are busy piecing together evidence before a decision is made by DPP Noordin Haji.
Kimathi, who accompanied Maxine to the Government Chemistry for further questioning by the Investigating Officer, Mr Stephen Kibei, said her saliva samples were taken for DNA profiling.
“I presented Maxine to Mr Kibei at Kilimani Police Station as directed by Milimani Senior Principal Magistrate Bernard Ochoi on December 14, 2022 for further processing by police,” Kimathi said.
He claimed they remained at the station for three hours, during which time Maxine was interrogated by the officer.
Kimathi revealed that six witnesses have already been summoned to record statements as police investigate Asad’s death.
Asad is said to have suffered serious injuries after a fight with his girlfriend on December 12 at their Nairobi home.
The advocate stated that he will return Maxine to Kilimani on December 29 for further questioning and advice.
Ochoi instructed her to continue reporting to the Investigating Officer until further orders from the court were issued.
Kimathi, who stated that the investigations have shifted from grievous harm to murder in the aftermath of Asad’s death, which was buried in an emotional ceremony at the Kariokor Muslim Cemetry on Tuesday.
Maxine was arrested and detained at Kilimani Police Station on December 12 after Adil Khan, Asad’s younger brother, reported the assault.
Adil stated that a security guard at the late Asad’s residence informed him of the assault.
Asad was rushed to Nairobi Hospital, where he was transferred to Avenue Hospital for blood transfusion.
Asad received 10 pints of blood at the Avenue Hospital, according to Adil, because he had lost a lot of blood following the assault.
Asad died on Sunday.
Ochoi turned down state prosecutor James Gachoka’s request to detain Maxine for 14 days for further interrogation and released her on Sh100,000 cash bail.
Maxine was ordered by Ochoi to appear in court on January 16, 2023.
Asad, 50, a celebrated rally driver who had been admitted to the Intensive Care Unit (ICU), was described by his brother (Adil) as humble, generous, and kind-hearted.
Asad and Adil both led a team of mechanics as members of the Service Crew for the Young FIA Team, which competed in a number of events across the continent this year.
