Mercy Tarus Faces Contempt of Court For Discussing Case On A Podcast

Written By Lisa Murimi

Activist Mercy Tarus found herself in legal trouble on Friday as she faced contempt of court accusations for failing to honor a summons related to the Finland Education Scholarship Scandal.

The prominent witness was also accused of publicly discussing sensitive details of the case during her appearance on the Iko Nini Podcast on July 24, 2024.

Appearing in court wearing a hoodie emblazoned with “Kenya ni Home,” Tarus struggled to provide a satisfactory explanation as the prosecution pressed her on the contempt allegations.

Senior Principal Magistrate Peter Ndege emphasized the seriousness of the accusations, stating, “Her attendance must therefore be physical like the other parties involved in the hearing.”

The court had previously ordered Tarus to testify on September 12 after respondents, including Uasin Gishu Governor Jackson Mandago, raised concerns about her actions.

Despite being served multiple court summons via WhatsApp, Tarus requested to attend the proceedings virtually, a plea that the defense team opposed.

Tarus contended that she first learned about the contempt charges through social media, disputing the prosecution’s claims.

The case has faced several hurdles, including witness absences and attempts by the judge to recuse himself from the matter.
