Mombasa County Gubernatorial aspirant Mike Mbuvi Sonko’s bid has received a huge blow after court dismissed his request to have the Independent Electoral and Boundaries Commission (IEBC) move to disqualify him suspended by the court.
The High Court in Mombasa has declined to suspend Sonko’s disqualification by the IEBC, in a move that is likely to block the former Nairobi governor from vying for the hotly contested race in mombasa to succeed Ali Hassan Joho.
High Court judge Justice John Mativo in declining Sonko’s request ruled that it would be dangerous to grant Sonko his prayers without giving IEBC a fair hearing.
The electoral commission in its preliminary objection filing against the case has argued that the High Court lacked jurisdiction to hear and determine the case, adding that it goes against the Elections Act by circumventing the IEBC dispute resolution committee.
