Mirema Residents Sue Night Clubs And Church Over Noise Pollution

Residents of Mirema Estate in Nairobi have successfully sued three entertainment venues and a church for noise pollution.

ELC Judge Justice Oscar A Angote decided in favour of the Amani Residents Welfare Association/Mirema following an affidavit given by the association’s head, Dominic Mbigi, and John Koogi, an estate resident, outlining the difficulties they experience.

Cocorico Wines, Paris Lounge and Grill, Tessara Entertainment, and Trinity House International Ministry were accused of violating the inhabitants’ right to a clean and healthy environment, as guaranteed by Article 42 of the Constitution.

The court also found that the National Environmental Management Authority (NEMA) and Nairobi City County failed in their duties to protect the residents’ rights.

The residents were awarded Sh5 million in compensation and the court ordered the closure of the entertainment venues and the revocation of their liquor licenses.

The court also ordered the church to regulate its sound systems.
