On Tuesday, September 16, 2025, Lady Justice Margaret Muigai temporarily halted a bail ruling in the case involving PC Klinzy Barasa, who is accused of murdering mask vendor Boniface Mwangi.
The pause followed an application by Mwangi’s mother, Susan Njeri Kariuki, who is requesting to play an active role in the proceedings.
Through her legal counsel, Njeri Kariuki seeks permission to participate fully in the trial, including asking questions, presenting evidence, and making submissions that reflect the impact of her son’s death.
In her application, she emphasized the importance of allowing her lawyer to represent her and her family’s interests as victims of the murder case under Section 203 of the Penal Code.
The court was also informed of a preliminary objection filed by the victim’s family legal team. Justice Muigai instructed that this objection be served to all parties, and that responses be filed and shared accordingly.
Meanwhile, PC Klinzy Barasa is pursuing bail or bond pending trial. In his application, he argues that he is the sole provider for his family, which includes a wife, two school-going children, and an elderly, sickly mother.
He highlighted the financial strain his detention has caused, noting that his children’s education and his mother’s care have been disrupted. Barasa also claimed that his wife has threatened to leave due to the pressures of managing the household alone.
The court is expected to revisit the matter in 14 days, for further directions.
