Court Finally Dismisses Case Against Former Mungiki Leader Maina Njenga

A case in which former Mungiki leader Maina Njenga and three others were accused of forcefully robbing three police officers of firearms and cash in a church seven years ago was dismissed by the Milimani Law Courts magistrate.

The case against the four was withdrawn today by Senior Principal Magistrate Martha Mutuku under Section 87 (A).

Njenga was arrested and charged together with five others, including businessmen Francis Mwangi, Wanjohi Ngare, and Stephen Kuria.

The alleged crime occurred in 2012 at his Hope Church in Nairobi’s Kasarani neighbourhood.

The case was withdrawn after prosecution witnesses repeatedly failed to turn up in court to testify against the accused a move vehemently contested by the defence lawyers Danstan Omari, Kiraithe Wandungi, and Evans Ondieki.

The defense accused the prosecution of purposefully prolonging the case by neglecting to provide witnesses, in order to avoid a full trial.
