Two Police Officers Implicated In Signature Forgery

Two Police officers were arraigned in Court today with charges of Conspiracy to defeat Justice contrary to the Law.

The two officers, Judy Musau and Bernard Malombe were charged that on January 10, 2019, at Dandora police station in Nairobi, jointly with others yet to be arrested conspired to defeat Justice by forging the signature of Josephine Mutindi Kithu, a complainant at Dandora Police Station.

The purported withdrawal bearing the forged signature was presented before Milimani Children’s Court as documentary evidence and was witnessed by Daniel Mutisya and Bernard Malombe respectively.

Further, they were charged with abuse of office were the two on the said date, did abuse of authority of their office as police officers an act prejudicial to the rights of Josephine Mutindi Kithu.

Separately, Judy Musau was charged with forging the signature of Josephine Mutindi Kithu with intent to deceive purporting it to be genuine and validly signed by Josephine Mutindi Kithu.

Appearing before Magistrate Zainub Abdul, they denied particulars of the charges. Their defence approached the court with a prayer to defer charges citing that the accused persons were pursuing alternative dispute resolution.

The court ruled that the accused persons had already taken a plea of not guilty and that the only way the plea would have differed was if one of the accused persons was sick. “If the charge sheet is brought before the court, a plea must be taken,” said the Magistrate.

They were released on a cash bail of Ksh 100,000. The case will be mentioned on October 18, for pretrial.
