The High Court has cleared Nairobi Senator Johnson Sakaja to run for the city’s gubernatorial seat in the August 9 elections.
This is after Justice Antony Mrima on Tuesday July 12, 2022 dismissed a petition lodged by Dennis Gakuu that challenged the validity of his degree.
According to the Court, the petitioner in the case did not present enough evidence to prove that Sakaja forged his academic documents.
“The court finds IEBC did not error to clear Sakaja to vie for Nairobi gubernatorial seat” ruled the Judge.
The County Returning officer of Nairobi County acted within the provisions of the Law by clearing Senator Sakaja to vie for the Gubernatorial seat.
He was certain that Sakaja had complied with all the legal requirements.
According to the law, IEBC officers are like caged animals that operate only within the parameters of the law.
They lack the necessary tools and machinery to conduct forensic document analysis.
“This court on the basis of adherence to the Rule of Law, finds no reason to add other duties to the IEBC which are not provided for in the Law…the application by the petitioner is therefore dismissed with orders of cost,” ruled Justice Anthony Mrima.
Wahome had asked the court to temporarily bar the commission from including Sakaja’s name on the ballot because his degree from Team University in Uganda is not authentic.
