High Court stays prosecution of a Lawyer believed to have Intermeddling with the property of a late Eastleigh millionaire by fraudulently taking possession of the property and disposing it off.
Advocate Salim Ali Mwatumbo was intended to be charged with defrauding the late Modhihiri Mohamed Modhihiri of a land located at Eastleigh measuring 0.2985 hectares valued Ksh 110,000,000.
Allegedly he drew a forged indenture conveyance.
The prosecution also intended to charge him with forgery where it is alleged that on or before November 5,2011 Salim forged a title deed of a land located in Eastleigh valued at Ksh 110,000,000.
In another Intended charge, it is alleged that he fraudulently obtained land registration by falsely preparing an Indenture of conveyance in consideration of the sum of Ksh 30 million pretending he had bought from the late Modhihiri Mohamed Modhihiri a fact he allegedly knew to be false.
However, Lady Justice Wendy Micheni yesterday issued an order restraining the Police and ODPP from arresting, detaining, arraigning in Court, charging or prosecuting the Lawyer for a period of 12 days.
The case will be mentioned on December 17, 2024.
