High Court judge Mugure Thande has granted conservatory Orders stopping the formal appointment of the new National Climate Change Council.
Through Lawyer Henry Kurauka, the Petitioners, namely, My. Kenya Network Forum and the Indigenous People National Steering Committee on Climate Change argued that the president offended the Constitution and the National Climate Change Act, 2016.
The Petitioners argue that there was no public participation contrary to Article 10 pf the constitution.
The Petitioners further argue that the impugned appointments are contrary to section 7 Climate Change Act which provides representatives to the council from civil society and marginalized communities.
The petition is scheduled for directions on 17th April 2023 for further directions.
