The developer of the six-storey building that collapsed at Kirigiti in Kiambu County were not registered according to the National Construction Authority (NCA).
NCA says they did not issue any approvals by the authority insisting that they had stopped this project in April.
As of Monday evening the death toll had risen to eight people.
Rescue efforts are still underway to rescue three more people feared to still be trapped in the rubble.
A woman and her two children were the first casualties to be evacuated from the rubble.
Two more bodies were recovered thereafter while three succumbed while undergoing treatment.
Three people are so far admitted to Kiambu Level 5 hospital and they are in stable condition.
The house collapsed on a residential house below it trapping some of those who were there.
The Institute of Engineers of Kenya and Public works Principal Secretary cited poor workmanship that has also caused seven other buildings to collapse in the county in recent months.
Area residents are now calling for a thorough inspection of buildings under construction in Kiambu County to curb such tragedies.
