Ngong Court Hands Life Sentences to Three Men in Violent Robbery Cases

A Ngong court has sentenced three men to life imprisonment after finding them guilty of violent robbery, marking a significant win for the Office of the Director of Public Prosecutions (DPP).

The convicts Brian Kutitila Wanyama, Japhnae Wanyonyi Mukalama, and Thomas Wakoli Malava were convicted under Section 296(2) of the Penal Code after prosecutors presented compelling evidence linking them to two separate violent robberies.

In the first case, the court heard that on December 18, 2021, at Kibiku in Kajiado West, the trio violently robbed Andrew Muthure Wairia of a Huawei Y9 mobile phone worth Ksh.24,990, a memory card valued at Ksh.3,995, and a pair of Reebok shoes worth Ksh.4,000.

They further transferred Ksh.3,970 from the victim’s account to a mobile number registered in Wanyama’s name. Wairia was physically assaulted during the attack.

The court ruled that the prosecution had proven all elements of the offence beyond reasonable doubt, sentencing the three to life imprisonment.

Separately, Wanyama was also convicted of willfully resisting arrest on December 29, 2021, in Bulbul, Kajiado North, earning him an additional two-year jail term.

In another case, Malava was found guilty of participating in a violent robbery on September 5, 2021, at Oloolua in Kajiado North, where he and accomplices stole valuables worth Ksh.227,000 including a smart TV, a Honda concrete vibrator, mobile phones, and Ksh.50,000 in cash from Patrick Nyaga Kariuki, who was also assaulted during the ordeal. For this second offence, Malava received an additional life sentence.

The successful prosecutions were led by Filah Martins, with the court affirming the severity of the crimes and the strength of the evidence presented.
