The state has withdrawn all the charges against Nick Mwendwa,the former FKF President.
This comes after the presiding Magistrate declined the prosecution’s application for adjournment of the case when the matter came up for hearing on the 4th July 2022.
The prosecution was given ultimatum to put their house in order by July 6,2022. However, the prosecution failed to adhere to the Court’s directive by approaching the court with unsubstantiated submission to prosecute Nick Mwendwa.
Nick Mwendwa’s defence team led by senior counsel Eric Mutua,Charles Njenga and Victor Omwebu strenuously opposed the application for adjournment.
This prompted the court to agree with the defense that the state was deliberately delaying the hearing of the matter which was instituted on 14th November 2021.
The charges have now been withdrawn under Section 87A of the Criminal Procedure Code (CPC)
