Football Kenya Federation (FKF) chairperson Nick Mwendwa is now free after the Director of Public Prosecutions (DPP) Noordin Haji dismissed the Sh38m theft case brought against him.
Consequently, Mwendwa, who had stepped aside pending the outcome of the case, can now resume his role as FKF boss.
Kiambu Senior Principal Magistrate Wilson Rading dismissed the accusations on Wednesday, calling them unfounded and illegal.
Rading stated that the accusations brought against Mwendwa were the outcome of an indecisive investigation by a commission designated by former Sports CS Amina Mohammed.
The magistrate freed Mwendwa and directed that he should not be apprehended and charged based on the same findings of the probe team.
Mwendwa’s lawyers Eric Mutua, Charles Njenga and Victor Omwebu asked the court to terminate the criminal case as it was an affront to Mwendwa’s fundamental and constitutional rights.
“After considering the evidence presented by Senior counsel Mutua Njenga and Omwebu, l find that they made a case to warrant this court’s intervention to protect the abuse of the court process,” ruled Rading.
He said Mwendwa has proven that the charges are fatally defective.
