Former National Youth Service (NYS) Director General Nelson Githinji, former Devolution Principal Secretary Peter Mangiti, and businessman Ben Gethi were all been found not guilty in the Sh791 million NYS 1 scam.
Milimani chief magistrate Wendy Micheni cleared the former senior civil workers in what was dubbed “NYS Season One” on Monday evening, stating that “the prosecution failed to produce enough evidence linking them to the theft of hundreds of millions.”
Mrs Micheni stated that the charges brought against the former senior NYS officials would have been established “if the prosecution had presented electronic evidence in their bid to pin down the suspects.”
According to the magistrate, “no prema-facie case has been established against the suspects to warrant the court to put them on their defence.”
The magistrate who reviewed the whole evidence led by the prosecution witness explaining each of the suspects’ responsibilities concluded that “no direct evidence links them to the loss at the NYS.”
The prosecution invited more than 50 witnesses to testify in the six-year-old case.
The case was heard by three magistrates, including Chief Magistrate Andayi.
Mr Mangiti, Mr Githinji, and Mr Gethi were charged alongside 23 other individuals, all of whom were found not guilty.
However, five of the suspects have been placed on trial.
