Obado Trial: Unborn Baby Could Have Survived

Slain Rongo University Sharon Otieno’s unborn child would have survived the stabbing ordeal if emergency services had arrived within 4 minutes of the brutal stabbing

The prosecution appeared in Court prepared to move the court emotionally and display to the public the pain late Sharon together with her unborn baby underwent before their untimely death.

Armed with an experienced expert witness, the prosecution proved to the court that the unborn fetus aged at 28 weeks at the time of termination, would have survived had Sharon’s body been discovered within 4 minutes after her murder.

Dr. Samson Wanjala, a gynecologist and a prosecution witness, told the Court that although the deep cuts sustained by late Sharon during her gruesome murder had affected the fetus too, there was some chances of saving the fetus within four minutes after the death of the mother.

“Suppose there was an intervention within four minutes, the chances that the baby would survive is 20%” said Dr. Samson Wanjala. 

Asked to give an expert conclusion on the chances of lady Sharon surviving in situation where intervention was done, the Doctor there was no chances of survival due to grievous injuries on the main blood vessels.

“Having gone through the overall picture of this scenario, late Sharon had no chances of survival. My conclusion is that Sharon was not given a chance to survive.” Said the doctor in cross-examination.

However, this final conclusion of the doctor was not received without vehement attack by the defense counsels. Mr. Kilukumi leading the defense counsel put on a spirited fight to have the conclusion sediments struck off the Court record.

The case proceeds on 22nd March, 2022
