KANU To Appeal Court Ruling Revoking KICC Land Title

The Kenya African National Union (KANU) party has disagreed with the High Court’s ruling on the Kenyatta International Convention Center (KICC) land.

In a ruling on Monday, June 3, Justice Jacqueline Mogeni said the KICC land was unlawfully acquired by KANU.

She revoked the title deed issued to KANU and declared that the land belongs to the Ministry of Tourism.

“A declaration that the Ministry of Tourism is the lawful owner of the land and KANU registration is unlawful, illegal and unconstitutional,” Justice Mogeni ruled.

However, KANU has announced it will move to the Court of Appeal to challenge the High Court ruling.

“The party has already instructed its legal team to file a notice of appeal with immediate effect as the party combs through the substance of the judgement to issue a comprehensive statement in due course,” KANU’s statement read in part.

The Gideon Moi-led party argued that the allocation of the parcel of land was procedurally effected under the previous constitution and therefore it is the legitimate and bona fide owner of the land.

KANU was allocated the land on May 10, 1969, by the commissioner of lands and acquired the title of the land on May 25, 1989.

On February 11, 2003, the independence party was kicked out of the land through an executive order by the late Mwai Kibaki.

In 2020, the party moved to the Environment and Land Court seeking to reclaim the premium property.

“We assure our members and supporters that the party will pursue all legal avenues to ensure that justice is served,” KANU added.

IPOA Launches Probe After Death Of Minor in Police Custody at Kambu

The Independent Policing Oversight Authority has launched investigations into an incident in which a minor died while in police custody at Kambu Police Station in Makueni County. 

In a statement on Monday, June 3, the oversight authority stated that its officers had already visited the scene of the incident and interviewed a number of witnesses.

IPOA maintained that upon completion of its investigations, it would recommend prosecution where criminal culpability is proven.

“On Friday 31, May 2024, and pursuant to Sections 6(a) of Cap.86 of the Laws of Kenya, IPOA on its own motion launched investigations into the death of a minor at the Kambuu Police Station in Makueni County, where his mother, Zipporah Mutheu, had been detained. Upon completion of investigations and where criminal culpability is proven, IPOA will recommend prosecution,” read part of the statement.

In the incident, Mutheu had been arrested on Wednesday, May 29, and taken into custody alongside her one-and-a-half-year-old baby.

The woman was reportedly assaulted by the officers who apprehended her, and it was alleged that some of the assaults landed on the baby. 

Mutheu was reportedly held in custody and denied a chance to seek medical assistance for her baby, who later died in police custody that evening.

In the meantime, IPOA has condemned the assault of a police officer along Kamiti Road, Kasarani on Sunday, June 2.

The oversight authority advised Kenyans who felt disgruntled with the policing services or police officers to lodge their complaints with the authority.

“IPOA strongly condemns such attacks noting that they interrupt the provision of security services and strip the public of policing services,” IPOA stated.

Met Department warns of extreme cold temperatures in six counties

The Kenya Met Department has warned of extremely cold temperatures of less than 10° Celsius in six counties.

In a statement on Monday, June 3, the weatherman said the cold temperatures will be experienced in Nyandarua, Narok, Nakuru, Nyeri, Kirinyaga, and Murang’a counties for the next one week.

The Met Department noted that rainfall amounts exceeding 50mm is expected in the Highlands East and West of the Rift Valley, the Lake Victoria Basin, and the Rift Valley while the rest of the country would be generally dry.

“Intermittent cold and cloudy conditions are expected over some parts the highlands east and west of the Rift Valley the South-eastern lowlands and the Rift Valley,” read the forecast in part.

The weatherman also warned of maximum temperatures exceeding 35°C in parts of Turkana, Mandera, and Samburu Counties during the forecast period.

Further, the Met Department announced that Winds of more than 25 knots (12.9m/s) are expected over parts of Turkana, Mandera, Marsabit, Lamu, Wajir, Garissa, Isiolo, and Kilifi Counties.

“These winds are strong enough and able to blow dust, especially over bare grounds. The blown dust may increase the risk of respiratory infections e.g. Cold and flu diseases.

“These diseases are quite common during the dry weather conditions. Residents are advised to be on the lookout for such diseases and take necessary protective measures,” the weatherman advised.

DCI recommends murder charges for ex-Gor Mahia footballer Collins Okoth

The Directorate of Criminal Investigations recommends murder charges against former Gor Mahia and Harambee Stars midfielder Collins Okoth, alias Gatusso over a body of a three-year-old girl found in his compound.

The Office of Director of Public Prosecutions (ODPP) is yet to approve the charges as they now require seven days to make the decision.

The DCI wants the footballer charged with the murder of a three-year-old girl found dead outside her mother’s house in Lucky Summer Estate in Starehe Sub County, Nairobi, on April 22.

On May 31, 2024, the ODPP received the DCI’s investigation file for review and is expected to make the decision within a week.

However, even before Gatusso faces charges, the investigations could result in the DCI denying him bail and bond, citing threats against witnesses.

The officer investigating the case, detective constable Gilbert Kiprotich, told a Makadara court that the community around Gatusso is wild against him, adding that members of the public want to kill the suspect.

Kiprotich pleaded with Senior Principal Magistrate Gerald Mutiso to detain Gatusso for 10 more days pending the ODPP’s decision, but the former Harambee Stars midfielder opposed the application through his lawyer. He stated that the government scientists have not yet received the DNA analysis report.

The detective reported threats against some witnesses in the case and urged the court to reject the suspect’s bond terms.

The victim’s mother also testified in court, stating that her family disowned her following the child’s death due to local customs.

She told the court that she was living in fear of Gatusso, whom she said could harm her and opposed his release on bond.

A friend, who is currently hosting her, informed the court that the deceased’s mother has been emotionally unstable and lives in fear. Okoth said that the DNA is not required by the court at this stage.

He claimed that the detective had not revealed the charges he had suggested to the ODPP, had received 21-day custodial orders to detain him, and had not shared the difficulties he encountered during that time.

But prosecution counsel Christine Kabale dismissed the argument that the DNA analysis report was not necessary.

“The DNA is a very important piece of evidence because it will either exonerate the respondent (Gatussi) or find him culpable,” stated Kabale.

Mutiso stated that he is allowing the suspect’s detention because witnesses are afraid of him. The ODPP is yet to make a decision on whether to charge or not.

He also mentioned the DCI’s legitimate concerns that members of the public might lynch the suspect.

“Kiprotich has credible information that witnesses are facing threats,” Mutiso said.

The magistrate remanded Gatusso at the Lucky Summer Police Station until June 13, 2024.

Lucky Summer assistant chief Peris Muthoni reported the murder to the Lucky Summer police station via OB17/22/04/2024, informing the police of a suspected murder and dumped child.

Police arrived at the scene, found the child half naked with bruises on her neck, and suspected sexual assault. Police suspect that the child may have been thrown there dead.

The minor was found half-naked and dead behind the apartment where she lived with her mother in a house on the ground floor.

The child’s mother had left the house at 1 a.m. and returned at 4 a.m. to find her missing.

Ministry Announces Public Auction of Cars Starting at Ksh30,000

The State Department for Environment and Climate Change under the Ministry of Environment has announced a public auction of a number of assorted items, including motor vehicles going for as low as Ksh30,000. 

In a notice on Tuesday, June 4, the state department invited bidders for the auction which will take place on Friday, June 14 at the Kenya Meteorological department Offices along Nging Road.

“The State Department for Environment and Climate Change shall sell by public auction the listed assorted furniture, scrap metal boarded unserviceable motor vehicles on Friday, June 14, starting from 10 am at the Kenya Meteorological Department offices auction grounds at Dagoretti Corner along Ngong Road,” read part of the notice.

Among the vehicles to be auctioned were a Nissan Tida going for Ksh30,000, Isuzu NPR (Ksh250,000), Mitsubishi van (Ksh150,000), Volkswagen Passat (Ksh200,000), Diahatsu Terio (Ksh298,000), Toyota Prado (Ksh300,000) and a Mitsubishi V31W Pajero at Ksh100,000.

Other vehicles were a Toyota Corolla with a reserve price of Ksh80,000, a Mitsubishi Pajero (Ksh120,000), and another Volkswagen Passat at Ksh200,000.

Besides motor vehicles, the state department announced the auction of furniture, assorted tires, hydrogen generators, concrete posts, hydraulic motor parts, GI pipes, a satellite dish, a lawn mower, combating rollers, a diesel tank and galvanized water storage tanks.

Interested bidders were requested to obtain detailed bidding documents from the state department’s headquarters at the NHIF Building 11th Floor during normal working hours.

They were also asked to view the items at the listed locations from June 4 to June 11 during working hours and were required to pay a non-refundable deposit of Ksh10,000.

The successful bidders shall pay 25 percent of the purchase price and all costs, applicable duties and taxes assorted with the transfer of the purchased motor vehicles.

“The unsuccessful bidders will be refunded bid deposits on presentation of the original receipt within a reasonable time after the auction. The state department and the appointed auctioneer reserve the right to reject all bids below the reserve price,” the notice further read.

The state department further noted that all purchased vehicles shall be collected in the various locations within seven days, failure to which the successful winner of the bid shall be charged Ksh1,000 a day in storage fee.

Kenya Secures Ksh30.9 Billion for Konza Digital Media City

Kenya has secured USD238 million (approximately Ksh30.9 billion) from the Korea Exim Bank for the funding of the Konza Digital Media City.

In a statement on Tuesday, June 4, Foreign Affairs Principal Secretary Korir Sing’oei disclosed that the funding was to establish a cutting-edge film and creative economy hub at Konza Technopolis.

“On the sidelines of the Korea-Africa summit, the government of Kenya and Korea Exim Bank, represented by Executive Director and Board Member H.E. Hwang Kiyeon, signed two funding agreements amounting to US$ 238M for the financing of Konza Digital Media City project to establish a cutting edge film and creative economy hub at Konza Technopolis,” Korir stated.

The financing came at a time when President William Ruto was attending the Korea-Africa summit at South Korea’s capital, Seoul.

Upon arrival in Korea on Monday, June 3, the president asserted that the Korea-Africa Summit was an opportunity to develop build stronger bonds with the Asian giant.

“The Korea-Africa Summit presents us with an opportunity to forge strong ties with the Asian giant, leveraging our combined strengths to promote mutual growth, address global challenges, and enhance solidarity for peace and security,” President Ruto remarked.

According to Korir, the Head of State, in his statement at the summit, emphasized that engagement with Africa was a smart choice and a critical imperative for any continent serious on a sustainable, prosperous and peaceful future.

President Ruto further encouraged South Korea to prioritize partnerships with Africa in the food security, technology, and health sectors, among others.

Meanwhile, Konza Technopolis was envisioned to be a sustainable, world-class technology hub and a major economic driver for the nation when it was launched in 2008.

Mbappe arrival leaves Barca fearing Madrid domination

Real Madrid wrestled the Spanish title back from Barcelona at a canter this season and, after claiming a record 15th Champions League, their signing of world football’s biggest star Kylian Mbappe rubs yet more salt in their rivals’ wounds.

Los Blancos’ addition of Mbappe to an already star-studded squad is a striking statement of intent and could tilt the domestic balance of power even further in Madrid’s favour.

Barcelona, grappling with self-inflicted debilitating financial challenges, cannot keep up in the arms race with Madrid.

Mbappe arrives for free at the end of his Paris Saint-Germain contract, but Barcelona would not be able to afford the 25-year-old’s lavish salary or sign-on fee.

Over the past decade Barca squandered hundreds of millions of euros on failed signings, including Philippe Coutinho, Ousmane Dembele and Antoine Griezmann, as well as satisfying a sky-high wage bill.

Madrid’s financial muscle is showcased by the fact they already boast Vinicius Junior who likes to play in the same area on the left side of the attack so Mbappe could even be considered a luxury arrival.

Coach Carlo Ancelotti will have to reconfigure his attacking set-up, with Rodrygo Goes potentially dropping out of the side to accommodate Mbappe.

However, Real Madrid president Florentino Perez sees Mbappe as the final piece of the puzzle to go with their completed Santiago Bernabeu stadium refurbishment.

By contrast Barcelona of late have contented themselves with loan arrivals and out-of-contract stars reaching the tail-end of their careers and looking for one last challenge.

They were unable to adequately replace veteran defensive midfielder Sergio Busquets last summer and their defence crumbled.

France captain Mbappe’s marquee arrival and numerous other already acquired young stars, including England international Jude Bellingham, can help Madrid dominate LaLiga for years to come.

In response Barcelona may look to hit back by targeting Nico Williams from Athletic Bilbao for the left flank of their attack.

The Spain international’s 50 million euro release clause makes him a more financially feasible option for the cash-strapped Catalans than other players of similar quality.

However, any significant arrivals would require Barcelona to first offload players to balance the books, potentially sacrificing some squad depth and balance.

Brace for impact

The Catalans are reduced to hoping Mbappe’s arrival could upset the harmony in Madrid’s dressing room, given his superstar status. Ancelotti may also take time to find the best system to fit the forward in.

Having committed to giving part of their television revenue away for the next quarter of a century in exchange for heavy investment two summers ago, Barcelona will need to rely heavily on their La Masia youth academy.

Various brilliant young players including Lamine Yamal and Pau Cubarsi have emerged recently, giving hope they can continue to battle Madrid’s millions with homegrown talent.

Barcelona have been on the sharp end of Mbappe’s explosive talent already, with the forward netting twice in April to knock them out of the Champions League in the last eight.

Including a hat-trick in 2021, Mbappe has six goals in four games against Barcelona.

Other Spanish sides will be dreading Mbappe’s impact too.

With Lionel Messi and Cristiano Ronaldo’s goalscoring exploits in the past, it has been eight years since any player has scored 40 league goals, but Mbappe has the capacity.

Opponents will likely sit deeper and deeper against Madrid to stop Mbappe and Vinicius vaporising them on the counter-attack, as they so often did against Barcelona in their heyday under Pep Guardiola.

Now the Catalans are bracing themselves for what Madrid and Perez hope will be a similar era of glittering success rather than another failed Galactico experiment.

Palmer’s first England goal inspires win over Bosnia in Euro warm-up

Cole Palmer scored his first England goal as the Chelsea forward’s penalty inspired a 3-0 win against Bosnia and Herzegovina in Monday’s Euro 2024 warm-up.

Palmer marked his maiden start for the Three Lions with a clinical spot-kick in the second half at Newcastle’s St James’ Park.

In only his third England appearance, the 22-year-old maintained his brilliant Chelsea form to underline his case to make Gareth Southgate’s Euro squad.

Trent Alexander-Arnold was England’s other stand-out performer in their penultimate game before the Euros get underway in Germany.

The Liverpool star – again deployed in midfield rather than at right-back by Southgate – scored England’s second goal to cap a lively display.

Harry Kane, who came off the bench in the second half on his return to fitness, bagged the third goal in the final seconds to put a flattering gloss on an inconsistent display from understrength England.

After drawing with North Macedonia in their last Euro qualifier before losing to Brazil and drawing with Belgium in March friendlies, England’s first win in four games brought more questions than answers for Southgate.

Palmer, Alexander-Arnold and Crystal Palace midfielder Eberechi Eze bolstered their chances of winning a seat on the plane to Germany.

But Ollie Watkins, Conor Gallagher and Jarrod Bowen might rue missing their chance to impress.

Southgate must cut seven players from his provisional 33-man squad by Friday’s deadline, which comes as they play their last warm-up against Iceland at Wembley that evening.

After several painful near-misses at major tournaments during Southgate’s reign, England are one of the favourites to win the Euros as they look to get their hands on a major trophy for the first time since the 1966 World Cup.

CLINICAL PALMER

Thirteen days before England’s Group C opener against Serbia in Gelsenkirchen on June 16, Bosnia’s visit to Tyneside started the countdown to the Euros.

But of Southgate’s starting line-up, six had fewer than 10 caps as Jude Bellingham, Phil Foden, Bukayo Saka, Kyle Walker, Luke Shaw and Harry Maguire were among the absentees.

Palmer showed an early flash of class with a deft pass to Watkins, but the Aston Villa striker could not find the accuracy to steer his shot past Bosnia keeper Nikola Vasilj.

Causing panic in the Bosnia defence with his pace and movement, Eze threatened to break the deadlock as he shimmied into the penalty area for a shot that Vasilj pushed away.

But England’s passing was ponderous and their movement too sluggish in a limp first half.

Watkins headed Alexander-Arnold’s corner just over immediately after the interval, with Palmer guiding a close-range effort narrowly wide as England finally raised their tempo.

Southgate’s men were rewarded for their improvement with a 60th minute penalty after Benjamin Tahirovic’s shirt pull sent Ezri Konsa sprawling.

Palmer scored nine penalties for Chelsea this season and he emphatically drilled his latest spot-kick past Vasilj.

Jarrad Branthwaite and Adam Wharton came on for their England debuts, but neither had many opportunities to shine.

Pressing his case to start at the Euros, Alexander-Arnold grabbed his third international goal with a superb volley from Jack Grealish’s cross in the 85th minute.

Kane had the last word, poking home from close-range in the 90th minute after James Maddison’s pass deflected to the England captain.

Mbappe’s Madrid move ‘a dream come true’

France forward Kylian Mbappe says it is a “dream come true” as his long-awaited move to Real Madrid was confirmed, external on Monday evening.

Mbappe, 25, will move to the Bernabeu Stadium on a five-year deal when his Paris St-Germain contract expires on 30 June.

He will earn 15m euros (£12.8m) a season, plus a 150m euro (£128m) signing-on bonus to be paid over five years, and he will keep a percentage of his image rights.

“Nobody can understand how excited I am right now!” Mbappe posted on Instagram.

“A dream come true. So happy and proud to join the club of my dreams.”

He will join a Madrid side fresh from winning La Liga as they captured a record-extending 15th European crown with victory over Borussia Dortmund in the Champions League final.

Mbappe’s arrival in the Spanish capital is likely to prompt suggestions of a new Galacticos era at the club given the exciting prospect of him lining up alongside Brazil forwards Vinicius Jr, Rodrygo and fellow new signing Endrick, and England midfielder Jude Bellingham.

Mbappe verbally agreed to join Real in February and announced in May he would leave the French champions at the end of the season.

He leaves the French capital as PSG’s record goalscorer, with 256 goals since he joined from Monaco on an initial loan in 2017.

The forward scored 44 goals in 48 matches last term and has been the leading scorer in the French top flight for the past six years.

At club level, he has won seven Ligue 1 titles – the first of those with Monaco, the remaining six with PSG – and has collected four winners medals in the French Cup.

The Frenchman won the Golden Boot at the 2022 World Cup in Qatar, where France lost to Argentina on penalties in a dramatic final.

However, he is yet to triumph in the Champions League, having been a beaten finalist in 2019-20 – something he will hope to rectify with a club that has made a habit of winning Europe’s elite club competition.

Chelsea’s appeal against Reece James’ four-match ban fails

Chelsea’s attempt to overturn Reece James’ ban for a red card has been rejected by the Football Association.

The Blues captain, 24, will miss the first three matches of next season after he was sent off for violent conduct when he fouled Brighton striker Joao Pedro last month.

James was banned for four matches in all, including Chelsea’s final-day win over Bournemouth, with the additional one-game ban imposed as a result of it being his second red card of the season.

Chelsea’s appeal claimed James was “disoriented” after being fouled from behind and that Pedro “made contact” first as he ran past, adding: “It had not been his intention to harm Mr Pedro, he was simply pushing him away with his foot.”

The FA rejected the appeal – having not found the account of the defender “persuasive” – and did not accept that he was disoriented as he caught the Brazilian just below his knee, describing the action as “unnecessary” and rejecting the claim that he was simply “pushing” Pedro away.

There will be no further right to appeal for James, who missed out on selection for Gareth Southgate’s Euro 2024 England training squad.

Chelsea received more cautions than any club in Premier League history last season, which former boss Mauricio Pochettino put down to ill-discipline, with Enzo Maresca having been named his successor for the upcoming campaign.
